WARRANTIES AND GUARANTEES

RESIN FLOORING WARRANTY

Resin Flooring Warranty  Issued by: West Coast Custom Coatings Pty Ltd 

ABN: 89 668 851 661  Effective Date: 1st July 2021  

1. Warranty Coverage 

West Coast Custom Coatings Pty Ltd ("the Company") warrants that the resin flooring system  supplied and installed by the Company will be free from defects in workmanship and materials  under normal use and service, subject to the terms and conditions outlined in this document.  


Warranty Periods 

Residential Projects: Two (2) years from the date of practical completion.  

Commercial / Industrial Projects: One (1) year from the date of practical completion.  


2. What This Warranty Covers  

This warranty covers the following, where they are directly attributable to defective  workmanship or materials supplied by the Company:  

  • Delamination or loss of adhesion of the resin flooring system from the prepared  substrate
  • Excessive peeling or flaking
  • Failure of the coating system due to incorrect installation by the Company.

 Where a valid warranty claim is accepted, the Company will, at its discretion:  

  • Repair the affected area, or
  • Recoat the affected area, or  
  • Replace the flooring system in the affected area  

The Company’s liability under this warranty is strictly limited to the cost of repair or replacement of the affected area only.  


3. What This Warranty Does Not Cover 

This warranty does not cover defects, damage, or failure arising from, but not limited to:  

  •  Normal wear and tear 
  • Scratching, scuffing, impact damage, or abrasion  
  • Chemical spills or staining not cleaned promptly or outside the product’s tested  tolerances  
  •  UV exposure, colour variation, fading, or yellowing 
  • Moisture vapour transmission, hydrostatic pressure, rising damp, or substrate  movement  
  • Cracking or movement of the underlying concrete or substrate  
  • Efflorescence, laitance, or existing substrate contamination  
  • Improper use, misuse, negligence, or abuse  
  • Failure to follow recommended care and maintenance guidelines  
  • Use of harsh, acidic, or solvent-based cleaners  
  • Damage caused by third parties, other trades, or subsequent works  
  • Alterations, repairs, or modifications carried out by others without written approval from  the Company  
  • Floor levelling, falls, drainage issues, or ponding water  
  • Aesthetic variations including swirl marks, roller marks, colour variation, aggregate  distribution, or natural finish irregularities inherent to resin flooring systems  

4. Substrate & Site Conditions  

This warranty applies only where the substrate was deemed suitable at the time of installation.  The Company does not warrant against:  

  • Latent defects within the concrete or substrate  
  • Changes in site conditions after installation  
  •  Moisture-related issues that develop post-installation  

Any quotation or installation based on estimated or customer-supplied measurements is  subject to confirmation. Variations in substrate condition may affect performance and are not  covered unless expressly stated in writing.  


5. Care and Maintenance  

To maintain warranty coverage, the floor must be maintained in accordance with the Company’s  care and maintenance guidelines, including:  

  • Regular sweeping and mopping using a pH-neutral cleaner  
  • Prompt cleaning of spills  
  • Avoiding abrasive tools, harsh chemicals, or steam cleaning  

Failure to maintain the floor appropriately may void this warranty.    


6. Warranty Claim Procedure  

To make a warranty claim, the customer must:  

1. Notify West Coast Custom Coatings Pty Ltd in writing within fourteen (14) days of  discovering the issue  

2. Provide proof of purchase and installation date  

3. Allow reasonable access for inspection  


The Company reserves the right to inspect the floor and determine, at its sole discretion,  whether the claim is valid under this warranty.    


7. Limitation of Liability  

To the maximum extent permitted by law, West Coast Custom Coatings Pty Ltd shall not be  liable for:  

  •  Indirect, incidental, or consequential losses  
  •  Loss of use, income, or business interruption  
  • Removal or reinstallation of fixtures, furniture, or equipment  

This warranty is not transferable and applies only to the original purchaser and original  installation location.    


8. Australian Consumer Law  

This warranty is provided in addition to any rights and remedies available under the Australian  Consumer Law. Nothing in this warranty is intended to exclude, restrict, or modify any  consumer guarantees that cannot be excluded under law.    



PAINTING WARRANTY

At West Coast Custom Coatings, we aim to provide a high level of customer service and quality of our painting works. If at any stage you feel that you have concerns regarding the painting works to your home or business, please let us know  immediately so we can kindly rectify any issues.  


PAINTING PROCEDURES  

We run a fully qualified & registered painting team in Western Australia. We are registered with the Painters Board of  Western Australia with registration number 7047. We also hold valid Public Liability & Workers’ Compensation insurance at  all times.  All our painting works & procedures are carried out in accordance with the Australian & New Zealand painting standards,  ‘AS/NZS 2311: 2017 Guide to the Painting Of Buildings’.  The procedure followed for the painting of your specific project is outlined in detail in the quotation provided for  acceptance.   


WARRANTY OF PAINT & PAINT PRODUCTS  

All paint suppliers provide their own manufacturers warranties for their products. These warranties vary depending on the  product & application, however, generally will be for anywhere between 12-36 months and covers for such events as  bubbling, peeling & discolouration. If any of these problems occur, please advise us immediately so we can contact the  appropriate representative for replacement.   


WARRANTY FOR WORKMANSHIP  

We provide a 3 month defect liability period on all painting works from the time the job is completed. Paint work is  considered defective if not completed in accordance with AS/NZS 2311. Our warranty covers painting defects & blemishes  that arise from our direct workmanship including:  

- Painting runs 

- Painting misses or bare surfaces 

- Wrinkling  

- Colour variations  

- Unfilled depressions  

- Irregular or course brush-strokes   


We take all due care to ensure our work is tidy & complete upon finishing our projects. Upon completion, we will ensure  you have assessed your work for any defects and had these touched up before payment of your final invoice.   Please note, we have the right to use our own professional discretion when assessing all surfaces for damage &  defects before filling depressions. Depressions must be visible from a normal 1.5m viewing position in natural light.   


Examples of events we are NOT responsible for: 

- Repair of extremely poor workmanship by other trades, such as poor plaster work resulting in uneven wall surfaces or significant shudder marking on white set plaster made by the plasterer.  

- Repair of damage caused by other trades, such as floor or carpet installation 

- Wear and tear resulting from general use such as marks, chips & scratches occurring after paintwork is complete.  

- Wear and tear resulting from moving foundations, such as cracking along cornice lines & in plaster.  


WARRANTY CLAIM PROCEDURE
